Legal Validity of Handover Reports
Reports generated by Handover are documents with full legal validity in Spain and across the European Union, in accordance with current European and Spanish law.
What is the eIDAS Regulation?
eIDAS is EU Regulation 910/2014, which establishes the legal framework for electronic signatures across all EU member states. It gives electronic signatures the same legal weight as handwritten signatures when certain conditions are met.
In Spain, eIDAS is complemented by Law 59/2003 on Electronic Signatures, which expressly recognises the validity of simple electronic signatures in civil proceedings.
What makes a Handover signature legally valid?
Verifiable IP log: The signer’s IP address is recorded and bound to the document at the exact moment of signing.
Server timestamp: The date and time are recorded by our server, not the user’s device, so they cannot be tampered with.
Verifiable consent: The signer receives the link by email, reviews the full document, and signs knowingly. The process is documented.
Cryptographic document hash: The final PDF receives a unique identifier generated at the moment of signing. Any later modification is detectable.
Where is it admissible as evidence?
Civil courts
Admissible in civil proceedings for damage claims, unpaid rent, or disputes over the condition of the property.
Deposit arbitration
Valid before regional deposit bodies such as INCASOL (Catalonia), IVIMA (Madrid), and equivalents in other autonomous communities.
Consumer bodies
Admissible in consumer arbitration for claims between landlord and tenant.
Frequently asked questions about legal validity
Under the eIDAS Regulation and Law 59/2003, a simple electronic signature with a verifiable IP log and timestamp is fully admissible as evidence in Spanish civil proceedings. Spanish courts have consistently recognised its evidential value.
They can question it, as with any evidence. However, the recorded metadata — IP, timestamp, sending email, document hash — makes a challenge extraordinarily difficult to sustain if the process was followed correctly.
